By accessing or using CyberPod Gateway ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Use of Service

You may use the Service only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

4. Intellectual Property

The Service and its original content, features, and functionality are owned by CyberPod and are protected by applicable intellectual property laws.

5. Limitation of Liability

To the maximum extent permitted by law, CyberPod shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

6. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance.

8. California Privacy Rights (CCPA/CPRA)

CyberPod does not sell or share your personal information as defined under the California Consumer Privacy Act (CCPA), Cal. Civ. Code § 1798.140(ad), or the California Privacy Rights Act (CPRA). 9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. You agree that any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.

Class Action Waiver: To the extent permitted by law, you waive any right to bring claims as a class action, collective action, or representative proceeding.
